WAIVER AND RELEASE OF LIABILITY

IMPORTANT – PLEASE READ CAREFULLY

By entering the premises of Anytime Golf and/or using the facility, you are agreeing to the terms of this Waiver and Release of Liability. This document affects your legal rights. If you do not agree to these terms, do not access the facility.

 

1. Acknowledgment of Risk

I understand and acknowledge that participation in golf and related activities, including the use of golf simulators and training equipment, involves inherent risks of physical injury, property damage, and other hazards. These risks include, but are not limited to:

• Misuse or malfunction of equipment

• Being struck by golf balls or clubs

• Slips, trips, or falls

• Injuries caused by my own actions or by the actions of other participants

I voluntarily choose to participate and assume all risks associated with these activities.

 

2. Release of Liability

I hereby waive, release, and discharge Anytime Golf, its owners, officers, employees (if any), contractors, affiliates, and landlords from any and all claims, liabilities, demands, losses, or damages arising from or related to my access to and use of the facility. This includes, but is not limited to, claims arising from:

• Injury, illness, or death

• Theft, loss, or damage to personal property

• Negligence of Anytime Golf or third parties

 

3. Indemnification

I agree to indemnify and hold harmless Anytime Golf from any claims, costs, damages, and liabilities (including legal fees) arising from:

• My use of the facility

• The actions of any guests I bring or allow into the facility

• Any violations of the facility’s Terms of Use or policies

• Damage caused by unauthorized or non-compliant use of the facility

 

4. Authorization of Video Surveillance

I understand that video surveillance is used in the facility’s public areas for safety and security purposes. I consent to being recorded and acknowledge that such footage may be used in case of rule violations, accidents, or investigations. No cameras are installed in private areas such as washrooms.

 

5. Agreement for Guests and Group Participants

By accepting this waiver and completing a booking, I certify that I am authorized to act on behalf of all individuals in my group, including guests I invite or allow into the facility. I further acknowledge and agree that:

• I have fully informed all guests and group members of the contents of this Waiver and the facility’s Terms of Use, and I have obtained their verbal or implied consent prior to proceeding with the booking.

• All such individuals shall be deemed to have accepted and agreed to this Waiver and the facility’s Terms of Use upon entering the premises.

• I assume full responsibility and liability for any claims, damages, or injuries arising from their participation or presence in the facility.

• Anytime Golf shall not be held liable for any incidents involving guests who have not personally accepted the waiver or who were not authorized to enter.

 

6. Health and Physical Condition

I certify that I am physically fit to use the facility and have no medical conditions that would prevent me from safely participating. I will not use the facility if I am under the influence of alcohol, drugs, or any condition that may impair my judgment or coordination.

 

7. Legal Jurisdiction

This Waiver shall be governed by the laws of the Province of British Columbia. Any dispute shall be resolved in the courts of British Columbia.

 

8. Acknowledgment

By checking the acknowledgment box during booking, or by entering the premises, I confirm that I have read, understood, and voluntarily accepted this Waiver and Release of Liability on behalf of myself and any guests I may bring.
